TCEQ’s New Rules

August 26, 2020 – 

HB 3552: Notice Requirements Regarding Termination of Fluoridation at Public Water Systems – This rulemaking will implement House Bill 3552 from the 86th Texas Legislation, 2019, to require a public water system which adds fluoride to their water to provide written notification to customers of the system and the commission of the intent to permanently terminate fluoride addition at least 60 days before the termination.

July 31, 2020 –

REVISED Pending Proposal, Permit Streamlining Pre-Injection Units (Rule Project No. 2016-022-331-WS) – This rulemaking would amend Chapter 331 to revise the regulations for PIUs associated with nonhazardous noncommercial Class I injection wells to be consistent with the regulations of the TCEQ’s solid waste management program. This rulemaking would also amend rules in Chapters 39, 50, and 55 to align with the changes in Chapter 331.

May 2020 –

Certain regulations from the May 2018 TCEQ Petroleum Storage Tank (PST) rules will go into effect starting January 1, 2021.
The Texas Commission on Environmental Quality’s Petroleum Storage Tank rules that became effective in May 2018 has different timelines for compliance. Some of these rules become enforceable after January 1, 2021, so facilities should review these rules and verify compliance before this deadline.

Background: TCEQ adopted rules incorporating changes from EPA’s 2015 revisions to the federal underground storage tank (UST) regulations in Title 40 Code of Federal Regulations (CFR) part 280. The rules were published in the Texas Register on May 25, 2018 and became effective on May 31, 2018.
